Mediation is a facilitated negotiation through an informal process in which an impartial third person help parties resolve a dispute but does not impose a solution. The parties often seek mediation voluntarily, but many courts have programs that require parties to mediate before or in lieu of proceeding to trial.
The desired result of mediation is an agreement suitable to the needs and interests of the parties involved in the dispute. In general, the agreement is summarized in written form, signed by the parties, and is enforceable according to the rules of contract law.
